Principles and basic ethical directives which shall govern ‘mediators’ and arbitrators in action.

Abundance in the pendency of litigations before law courts and forums that increase day by day, expand the scope of ADR resolutions which are far more cost effective and time saving the effective involvements of mediators and arbitrators are becoming essential to find out alternate remedies. It follows that their rolls in finding out effective solutions to supplement or replace the lagging procedural remedies of the courts and forums like tribunal or commissions assume more timely and relevant importance in the justice delivery system of India.

Therefore it follows that the mediators and arbitrators of the GCADR are to be guided by due ethical behaviour and standard and principle way out to deliver valuable services in restoring justice and fair play in the resolutions of various disputes before them.

Basic ethical codes and principals to bind the GCADR mediators and arbitrators.

1) While discharging their duties as officers of the GCADR mediators/arbitrators, shall hold high the reputed parameters and standards of GCADR set up and high degree of honesty and integrity expected of a GCADR official.

2) Proceedings of mediation/ conciliation/arbitration shall be transparent and open both in exposures processing and in content.

3) Before, during and on conclusion of the problems in hand, GCADR officials shall display due honesty, sensibility, fairness and efficiency dispassionately to the resolution process without identifying themselves with the parties or the issues setup for resolution.

4) All problems or issues raised before or assigned for solution to them shall be dealt with diligently, honesty and impartially without any bias or prejudice whatsoever.

5) Confidentiality shall be the benchmark to be kept up by GCADR officials, while resolving any dispute and even after throughout. Arbitrators, mediators, or conciliators are free to disclose their nexus if any with the parties concerned and shall seek appointment of those officers who have no connection with the parties to the dispute or witnesses to be examined so that even any apparent interest in the parties or subject matter can be ruled out.

6) Officials of GCADR shall desist from misusing any information’s disclosed while on resolution process, in any other proceedings of any nature whatsoever. This condition is required to prevent misuse of confidential information’s.

7) Any resolution shall be concluded on a time bound basis

8) No information’s supplied or deciphered during the process of resolution of any category by the parties or GCADR officials, or shall not be misuse or even utilised as a matter of course by any party to resolve any dispute.
