Dispute Resolution Process

Arbitration process

  • 1️⃣ Claimant sends a Notice to Arbitrate (NTA) to Respondent via email and a copy to GCADR at resolve@gcadr.com, requesting initiation of arbitration proceedings for the dispute.
  • 2️⃣ GCADR acknowledges the NTA via email and provides guidelines on further steps, e.g., creation of login, timeline for filing the claim, etc.
  • 3️⃣ Claimant logs Claim on GCADR platform (Statement of Claim, supporting evidence, Interim Order application if needed).
  • 4️⃣ Claimant submits claim and provides undertakings/declarations that documents and facts are true and correct.
  • 5️⃣ GCADR assigns Case Officer.
  • 6️⃣ Case Officer appoints Arbitrator
  • 7️⃣ Arbitration proceedings start. Can be based only on documents through virtual hearings as decided by the arbitrator.
  • 8️⃣ Respondent files their response with proof, and parties interact with arbitrator queries directly on the online platform.
  • 9️⃣ Final Digital Award by the arbitrator.
  • 🔟 Final binding Award delivery on stamp paper to both parties.

Definitions

  • Claimant: The party that initiates the dispute resolution process and is claiming for a relief. Respondent: The party against whom the dispute is logged.
  • Case Officer: GCADR employee who facilitates the process and is the single point of contact for all parties.
  • Arbitrator: The person adjudicating the dispute.
  • Notice to Arbitrate: A notice sent by the party initiating the arbitration, informing the other party of intention to arbitrate if there is no resolution within 5 days.
  • Statement of Claim: A document from the Claimant which has details of the dispute and any proof.
  • Interim Order: As per Section 17 of the Arbitration and Conciliation Act, a party can request for an interim order early in the proceedings to attach bank accounts/assets to reduce risk.
  • Arbitrator Order: Order from the arbitrator seeking information relating to the dispute.
  • Arbitral Award: Final legally binding decision from the Arbitrator.
